Our Services include obsidiandynamics.co.uk, Project SkyGrid (projectskygrid.com), and Strait Signal (strait-signal.com). By accessing or using any of our Services, you agree to be bound by these Terms.

You must be at least 18 years old and have the legal capacity to enter into binding agreements to use our Services. If you are using the Services on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

4. Nature of Our Services

4.1 Advisory Intelligence

All detections, alerts, risk scores, and intelligence outputs provided by Project SkyGrid and Strait Signal are advisory in nature. They are derived from publicly available data sources and proprietary algorithms, and are intended to support — not replace — human decision-making.

4.2 No Guarantee of Accuracy

While we strive for accuracy, we do not guarantee that our data, detections, or analytics are error-free, complete, or current. Sensor data, including ADS-B and AIS, is subject to interference, gaps, and anomalies beyond our control.

4.3 Not Professional Advice

Our Services do not constitute aviation, maritime, legal, financial, or other professional advice. Users should exercise independent judgement and consult appropriate professionals before making operational decisions based on our outputs.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorised access to any part of the Services, other users' accounts, or our systems.
• Reverse engineer, decompile, or disassemble any part of the Services.
• Use the Services to transmit malware, spam, or other harmful content.
• Resell, redistribute, or sublicense access to the Services without our written consent.
• Use automated tools to scrape, crawl, or extract data from the Services beyond authorised API usage.
• Interfere with or disrupt the integrity or performance of the Services.

6. Intellectual Property

All content, software, algorithms, designs, trademarks, and other intellectual property associated with the Services are owned by or licensed to Obsidian Dynamics Limited. You are granted a limited, non-exclusive, non-transferable licence to access and use the Services in accordance with these Terms.

Data outputs delivered via our API or dashboards may be used within your organisation for internal purposes, subject to any additional restrictions in your subscription agreement.

7. API Usage

Access to our APIs is subject to rate limits and usage quotas as specified in your subscription plan. You agree to implement appropriate error handling and not to exceed published rate limits. We reserve the right to throttle or suspend API access that degrades service quality for other users.

8. Pricing and Payment

Paid features are billed according to the pricing plan selected at the time of subscription. Prices are subject to change with 30 days' notice. Payment is processed by our third-party payment provider. You are responsible for all taxes applicable to your jurisdiction.

9. Limitation of Liability

To the maximum extent permitted by law:

• Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
• Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the total fees paid by you in the 12 months preceding the claim.
• We are not liable for decisions made based on our advisory intelligence outputs, including but not limited to trading, routing, operational, or security decisions.

10. Indemnification

You agree to indemnify and hold harmless Obsidian Dynamics Limited, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will do so.

12. Changes to These Terms

We may modify these Terms at any time. We will post the updated version on this page with a revised "Last updated" date. Material changes will be communicated via email or a prominent notice on the Services. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England & Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England & Wales.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
